Legal Separation vs. Divorce: What's the Difference?

Legal separation lets you live apart and divide finances while staying legally married. Here's when it makes sense and how it differs from divorce.

Legal separation and divorce look similar on paper, both divide property, set support, and create a parenting plan, but they end in very different places.

The core difference

A divorce legally ends your marriage; you're free to remarry. A legal separation keeps you legally married while you live apart under court-ordered terms. Everything about money and children can be settled either way.

Why choose separation

Couples choose legal separation for specific reasons: religious beliefs that discourage divorce, keeping a spouse on health insurance, meeting a residency requirement before divorcing, or simply wanting time apart before making the final call. Some states don't offer it at all.

Can you convert it to divorce later?

Usually yes. Many couples who separate later convert it to a divorce, and the terms you already agreed on often carry over, which can make the eventual divorce simpler.

If you're certain the marriage is over and you want to remarry someday, divorce is the cleaner choice. If you need to stay married for a practical reason but live independently, separation may fit better.
